Terms

1. Scope

These terms govern sales by Dlimit Tactic S.L. (Dlimit brand) through dlimit.ch. We contract exclusively with entrepreneurs within the meaning of § 14 BGB, that is, with persons acting in the exercise of their commercial or independent professional activity; by submitting the order, the buyer expressly confirms this. We do not sell to consumers.

2. Prices and taxes

Prices are shown in euros excluding VAT. Deliveries in Germany: 19% VAT is added. Businesses in other EU countries with a valid VAT number: VAT-exempt intra-Community supply (§ 4 No. 1 lit. b and § 6a UStG); the buyer accounts for the acquisition in its own country. Deliveries outside the EU: import duties and taxes are borne by the buyer. Shipping costs are calculated according to country and quantity, stated on the proforma invoice and paid by the buyer. If a published price contains an obvious error, we will inform you before production.

3. Order, proof and payment

When you submit the form, we receive your order request. We check the files and send you a digital proof and a proforma invoice. The contract is concluded when you approve the proof and pay the proforma invoice by bank transfer or by another method stated on it; production then begins. As the products are custom-made, the order can no longer be cancelled once the proof has been approved.

4. Lead times and delivery

Production takes 3–5 working days from approval and payment, plus shipping (about 10 working days in total). Lead times are approximate and may vary for reasons beyond our control, such as transport incidents or force majeure. Risk passes to the buyer upon delivery to the address provided.

5. Customer designs

The customer warrants that it is entitled to use the logos, trademarks and designs it sends us and holds Dlimit Tactic S.L. harmless from any third-party claims on that account. The approved proof is the reference for production; slight colour variations inherent in printing may occur.

6. Returns and warranty

Posts, belts and wall-mounted belt units are made to the customer’s design, so returns are not accepted except in the case of manufacturing defects; if a consumer were exceptionally to place an order, there is no right of withdrawal for those products under § 312g Abs. 2 Nr. 1 BGB. Unpersonalised catalogue items – the wall receiver, the magnet set and the sign holder – may be returned unused and in their original packaging within fourteen days of delivery; return shipping costs are borne by the buyer. Transport damage must be noted on the delivery note and reported within 48 hours of receipt. Apparent defects must be reported to info@dlimit.ch without delay and in any event within 30 days of receipt (§ 377 HGB); hidden defects must be reported without delay after they are discovered and within the statutory warranty period. We will repair or replace the goods.

7. Liability and ownership

The liability of Dlimit Tactic S.L. for damages is limited to the amount of the order concerned. This limitation does not apply in cases of intent or gross negligence, to injury to life, body or health, to breach of essential contractual obligations, or in any other case where Spanish law imposes liability that cannot be limited. The goods remain the property of Dlimit Tactic S.L. until paid in full (retention of title).

8. Governing law

These terms are governed by Spanish law, excluding the United Nations Convention on Contracts for the International Sale of Goods. Any dispute shall be submitted to the exclusive jurisdiction of the courts of Mataró (Barcelona), Spain.
